1. Acceptance and changes
These Terms form a binding agreement between you (or the entity you represent) and SawStream. If you are agreeing on behalf of an organisation, you represent that you have authority to bind that organisation. We may update these Terms from time to time; we will update the "Last updated" date and, for active customers, give notice by email or in-app for material changes. Continued use after the effective date is acceptance of the updated Terms.
2. Your account
- You must provide accurate registration information and keep it up to date.
- You are responsible for safeguarding your password and any actions taken under your account. Tell us immediately if you suspect unauthorised access.
- You must be at least 18 years old (or the age of majority in your jurisdiction) to use SawStream.
- One human user per account. Sharing a single account across multiple people is permitted only within a single organisation and only when each person is bound by these Terms.
3. Subscription, billing, and refunds
SawStream is a paid subscription service. Plans, prices, and renewal cadence are listed at sawstream.com or communicated to you at sign-up.
- Merchant of record. Billing is processed by Paddle, our merchant of record. Paddle handles payment, taxes, and invoicing in your jurisdiction. Your payment is governed by Paddle's buyer terms in addition to these Terms.
- Auto-renewal. Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date. You can cancel at any time from your account; cancellation takes effect at the end of the current paid period.
- Taxes. Prices are exclusive of taxes unless stated otherwise. Paddle calculates and remits applicable taxes.
- Refunds. Subscription fees are non-refundable except where required by law. We may, at our discretion, issue prorated refunds in cases of service interruption or in goodwill on request.
- Failed payments. If a payment fails, we may suspend access until the balance is settled. Repeated failures may result in account termination.
- Price changes. We may change subscription prices on renewal with at least 30 days' notice.
4. Trial accounts
We may offer free trials. During a trial you may use the service subject to these Terms. Trials end automatically on the trial expiry date unless you upgrade to a paid plan; expired trial accounts may have access restricted or removed without further notice. We may modify or end trial offers at any time.
5. Acceptable use
You agree not to:
- Use the service in violation of any law, regulation, or third-party right (including the terms of your connected platforms such as Salesforce or Airtable).
- Reverse engineer, decompile, or attempt to derive the source code of the service, except to the extent the law expressly permits.
- Probe, scan, or test the vulnerability of the service, or breach any security or authentication measures.
- Send spam, malware, or content that is unlawful, defamatory, harassing, infringing, or otherwise harmful.
- Use the service to display data you do not have the right to display, or in a manner that violates the privacy of any individual.
- Use the service to compete with SawStream or to build a competing service.
- Resell, sublicense, or repackage the service without our written permission, other than embedding query output on websites you control or operate.
- Bypass usage limits, rate limits, or allowed-origin restrictions, or attempt to access another customer's data.
6. Your data and your CRM
- You retain rights. Records you fetch from your CRM through SawStream remain your property. We do not claim ownership of your data and we do not sell it, mine it, or use it to train machine-learning models.
- License to operate. You grant SawStream a worldwide, non-exclusive, royalty-free licence to host, transmit, render, and display your data solely as necessary to provide the service to you and to your authorised website visitors.
- Connected platforms. You are responsible for the configuration and security of your CRM and any other platform you connect. You must keep credentials current and revoke them promptly when access is no longer required.
- Your customers' privacy. If you display personal data through SawStream embeds, you are the controller of that data. You are responsible for any consents, notices, or contracts your data-protection law requires (including a Data Processing Agreement with us where applicable).
- Data export and deletion. You can delete queries, disconnect platforms, and close your account at any time. On account closure, we delete or anonymise your account data per our Privacy Policy.
7. Public embeds and end users
SawStream renders embeds on third-party websites you control. Each embed is identified by a public token and locked to the allowed origins you configure. You are responsible for:
- Selecting which fields and records are exposed.
- Configuring allowed origins to scope embeds to your own domains.
- Any privacy notices or cookie disclosures the embedding website is required to display under applicable law.
We will enforce the allowed-origin list and our token scheme as documented, but we cannot guarantee that no determined party can scrape data you have chosen to publish.
8. Service availability
We aim to make SawStream available with high reliability and continuously improve it. We do not, however, offer a contractual uptime guarantee for the standard plan. We may perform maintenance, deploy updates, or temporarily restrict the service to protect its integrity. Where reasonably possible, we will notify customers of planned maintenance.
9. Confidentiality
Each party may receive confidential information from the other in connection with the service. The receiving party will use such information only to perform under these Terms, will protect it with at least the same care it uses for its own confidential information, and will not disclose it except to personnel and contractors who need it and are bound by confidentiality obligations no less protective than these.
10. Intellectual property
SawStream, including the dashboard, query engine, layout templates, embed loader, documentation, and the SawStream brand, is owned by SawStream and its licensors and is protected by intellectual-property laws. Except for the limited rights expressly granted by these Terms, we reserve all rights. Feedback you provide may be used by us without restriction or compensation.
11. Suspension and termination
- By you. You may cancel at any time from your account. Cancellation takes effect at the end of the current paid period.
- By us. We may suspend or terminate your access if you breach these Terms, fail to pay, expose us to legal or security risk, or use the service in a way that materially harms us or other customers. Where reasonable we will give notice and an opportunity to cure.
- Effect of termination. Your right to use the service ends immediately. Sections that by their nature should survive (payment, IP, confidentiality, disclaimers, limitation of liability, indemnification, governing law) will survive.
12. Disclaimers
Some jurisdictions do not allow the exclusion of certain warranties, so portions of this section may not apply to you.
13. Limitation of liability
These limits do not apply to a party's payment obligations, indemnification obligations, breach of confidentiality, infringement of the other party's intellectual property, or to liability that cannot be excluded under applicable law.
14. Indemnification
You will defend, indemnify, and hold harmless SawStream and its affiliates, officers, employees, and agents from and against third-party claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your data; (b) your use of the service in violation of these Terms or applicable law; (c) the configuration of your connected platforms or embedded websites; or (d) any failure to obtain required consents from individuals whose personal data you display through the service.
15. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. The parties consent to the exclusive jurisdiction of the state and federal courts located in Wyoming for any dispute that is not required to be arbitrated. Each party waives any right to a jury trial. The UN Convention on Contracts for the International Sale of Goods does not apply.
16. General
- Entire agreement. These Terms, together with the Privacy Policy and any order form or written agreement we sign with you, are the entire agreement between us regarding the service.
- Assignment. You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither party is liable for failures caused by events beyond reasonable control (natural disasters, war, network outages, etc.).
- Severability and waiver. If any provision is held unenforceable, the remainder will remain in effect. A failure to enforce any right is not a waiver.
- No agency. Nothing in these Terms creates a partnership, joint venture, or agency relationship.
- Notices. We may send notices to the email on your account. Notices to us must be sent to the address below.
